These Terms apply to all interactions with Poison Ivy Removal Company, including:
A binding service agreement is created when you receive and accept a written quote from us, whether by email, text, or signed document. Verbal agreements are not binding. We reserve the right to decline any service request at our discretion.
All site inspections and removal work are scheduled subject to weather, crew availability, and property access. We will make reasonable efforts to honor scheduled appointments but are not liable for delays caused by weather, illness, or circumstances outside our control.
Payment terms are stated in your written quote. Unless otherwise agreed in writing:
We accept payment by check, credit card, and ACH transfer unless otherwise specified. Returned checks are subject to a $35 returned payment fee. Balances not paid within 30 days of the due date may accrue interest at 1.5% per month.
You may cancel or reschedule an on-site appointment at any time with no charge. We would rather hold your spot and work with you on a new date than penalize a cancellation, since rebooking can otherwise push your service out by months.
We reserve the right to reschedule any appointment due to weather or unsafe conditions at no penalty to either party. We will provide as much notice as possible.
Site inspection fees are non-refundable once the inspection has been performed. If you book removal work within the same season following an inspection, the inspection fee is credited toward the removal total.
We do not offer refunds for completed on-site removal services except in cases of demonstrable error on our part. If you find a full-grown poison ivy plant within a week of our visit, that's on us. We will come back and remove it at no charge.
You agree to provide safe and reasonable access to the property for the duration of the service. This includes notifying us of any known hazards, restrictive easements, buried utilities, aggressive animals, or other conditions that may affect the work.
Poison ivy removal involves inherent risk of urushiol exposure. We take extensive precautions including full protective suits, gloves, and proper disposal procedures. However, residual urushiol may remain on surrounding surfaces, tools, or plant debris not directly removed. We are not liable for incidental exposure resulting from pre-existing plant growth outside the agreed scope of work.
We photograph properties before and after work for our records, quality assurance, and marketing purposes. By booking a service, you grant us a non-exclusive license to use before-and-after photos of the work area for promotional purposes. No identifying personal information (names, addresses, identifying structures) will be published without your explicit consent.
Consulting advice is provided based on information you supply and our professional experience. We make no guarantee that following our recommendations will eliminate all poison ivy from a given property, as plant biology and environmental conditions vary. Consulting is advisory only and does not replace a physical site inspection.
All content on this website, including text, images, and logos, is owned by Poison Ivy Removal Company or licensed to us, and is protected by applicable copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written consent.
Our services are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that poison ivy will not regrow after removal, as regrowth is a natural biological process dependent on environmental factors outside our control.
To the maximum extent permitted by applicable law, Poison Ivy Removal Company and its employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our services or website, even if advised of the possibility of such damages.
Our total liability for any claim arising from a service shall not exceed the amount you paid us for that specific service.
You agree to indemnify and hold harmless Poison Ivy Removal Company, its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of our services, or your violation of any law or the rights of any third party.
Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of those sites. Links do not constitute endorsement.
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the courts of Hillsborough County, New Hampshire.
We prefer to resolve disputes informally. If you have a concern, contact us first at office@pircne.com. If we cannot resolve the matter within 30 days, disputes may be submitted to binding arbitration under the rules of the American Arbitration Association, with proceedings conducted in New Hampshire. You waive the right to participate in class action litigation against us.
We may update these Terms at any time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of our services or website after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify existing customers by email.
